ARTICLE 1 – DEFINITIONS

Cooling-off period:

ARTICLE 3 – APPLICABILITY

These general terms and conditions apply to every offer from the entrepreneur and to every distance contract between the entrepreneur and the consumer.

Furthermore, these terms and conditions and article 16, the additional provisions for business customers, apply to business customers.

The text of these general terms and conditions is made available to the consumer before the conclusion of the agreement.

If one or more provisions are found to be wholly or partially void, the remaining provisions remain fully in effect.

In case of uncertainty about the interpretation of one or more provisions, interpretation according to the spirit of these general terms and conditions applies.

ARTICLE 4 – THE OFFER

The offer is without obligation.

Images and specifications provide a truthful representation of the offered products. Colour deviations may occur due to screen settings.

Apparent errors or mistakes in the offer do not bind the entrepreneur.

All Prices Are including VAT and Exclusive Shipping costs, unless otherwise stated.

ARTICLE 5 – THE AGREEMENT

The agreement is concluded at the moment the consumer accepts the offer and pays the amount due.

Electronic orders are confirmed by the entrepreneur via email. This confirmation may end up in the spam folder. The entrepreneur is not responsible for email being blocked by the consumer’s mailbox or for incorrectly entered email addresses.

The entrepreneur can refuse orders if there are valid reasons, even after payment has been made.

Every agreement is made subject to sufficient availability of the relevant products.

ARTICLE 6 – RIGHT OF WITHDRAWAL (CONSUMER)

The consumer has the right to cancel the agreement within 14 days of receipt without giving any reason.

The reflection period starts the day after receipt of the product.

Returns must be registered in advance by e‑mail via info@jootjeshaakcadeautjes.nl stating:

  • Name as stated on the Order
  • order number
  • to be returned Products and quantities
  • optional: reason for return

After registration, the product must be returned to the return address provided by the merchant within 14 days.

Products must be returned unused, clean, and in original condition and original packaging (unless otherwise agreed).

Returns without prior notification may be Become refused.

The consumer must use a shipping method that provides proof of shipment and retain the proof.

ARTICLE 7 – EXCEPTIONAL TRIAL ORDERS AND ABUSE

Excessive trial orders are defined as orders where larger quantities and/or multiple colours or variants are placed without prior information gathering, after which more than 40% of the order is returned.

This also includes the scenario in which a consumer only wants to obtain one pacifier chain, but orders a substantial amount (for example over €60) because of free shipping or a wide selection, intending to return most of it.

If there is repeated, excessive, or clearly unreasonable return behaviour, the merchant may:

ARTICLE 8 – COSTS IN CASE OF WITHDRAWAL

The Products comply with the agreement and the applicable legal requirements and guidelines.

Payment must be made immediately via one of the offered online payment methods.

ARTICLE 16 – ADDITIONAL PROVISIONS FOR BUSINESS CUSTOMERS

Business customers do not have a statutory right of withdrawal.
