ARTICLE 1 – DEFINITIONS
Cooling-off period:
The period within which the consumer can exercise their right of withdrawal.
Consumer:
The natural person who is not acting in the exercise of a profession or business and enters into a distance contract with the entrepreneur and thus does not offer their creations for sale.
Business customer:
Every natural person or legal entity acting in the exercise of a profession or business.
Day:
Calendar day.
Right of withdrawal:
The possibility for the consumer to withdraw from the distance contract within the cooling-off period.
Model form:
The European model form for withdrawal.
Entrepreneur:
Jootjes Haakcadeautjes, located in IJsselstein.
Distance contract:
A contract where only one or more distance communication techniques are used.
Distance communication technique:
Means that can be used to conclude a contract without simultaneous physical presence of parties.
General Terms and Conditions:
The present terms and conditions of the entrepreneur.

ARTICLE 3 – APPLICABILITY
These general terms and conditions apply to every offer from the entrepreneur and to every distance agreement between entrepreneur and consumer.
Furthermore, these conditions and article 16, the supplementary provisions for business customers, apply to business customers.
The text of these general terms and conditions will be made available to the consumer before the conclusion of the agreement.
If one or more provisions prove to be entirely or partially void, the remaining provisions remain fully in force.
In case of ambiguity regarding the interpretation of one or more provisions, the interpretation according to the spirit of these general terms and conditions applies.
ARTICLE 4 – THE OFFER
The offer is non-binding.
Images and specifications provide a true representation of the offered products. Color deviations may occur due to screen settings.
Apparent errors or mistakes in the offer do not bind the entrepreneur.
All prices include VAT and exclusive shipping costs, unless otherwise stated.
ARTICLE 5 – THE AGREEMENT
The agreement is concluded at the moment of acceptance of the offer by the consumer and payment of the amount due.
Electronic orders are confirmed by the entrepreneur per email. This confirmation may end up in the spam folder. The entrepreneur is not responsible for blocking of email by the consumer's mailbox or for incorrectly entered email addresses.
The entrepreneur may refuse orders for valid reasons, even after payment has been made.
All agreements are entered into subject to the sufficient availability of the relevant products.
ARTICLE 6 – RIGHT OF WITHDRAWAL (CONSUMER)
The consumer has the right to dissolve the agreement within 14 days of receipt without giving any reason.
The cooling-off period starts on the day after receipt of the product.
Returns must be reported in advance via email at info@jootjeshaakcadeautjes.nl stating:
- name as mentioned on the order
- order number
- to return products and quantities
- optional: reason for return
Upon registration, the product must be returned within 14 days to the return address provided by the entrepreneur.
products must be returned unused, clean, and in their original condition and original packaging (unless otherwise agreed).
Returns without prior notification may be refused.
The consumer must use a shipping method with proof of shipment and keep the proof of shipment.
ARTICLE 7 – EXCESSIVE TRIAL ORDERS AND MISUSE
Excessive trial orders are understood to be: orders where larger quantities and/or multiple colors or variations are ordered without prior information acquisition, after which more than 40% of the order is returned.
This also includes the scenario where a consumer wishes to produce only one pacifier chain, but orders for a substantial amount (e.g., above €60) due to free shipping or a wide selection, with the intention of returning the majority.
If there is repeated, excessive, or manifestly unreasonable return behavior, the entrepreneur can:

ARTICLE 8 – COSTS IN CASE OF WITHDRAWAL
The costs of return shipment are for the account of the consumer.
The entrepreneur will refund the purchase amount within 14 days of correct receipt of the return shipment.
Refunds will be issued via the same payment method used for the original transaction, or – by agreement – in the form of a voucher.
Damage, depreciation, or loss resulting from returns is for the account of the consumer.
ARTICLE 9 – EXCLUSION OF RIGHT OF WITHDRAWAL

- personalized items
- custom-cut pieces satin cord
- products which by their nature cannot be returned
ARTICLE 10 – THE price
prices will not be increased during the validity period of the offer, except for statutory changes.
Printing and typesetting errors are reserved.
The entrepreneur is not obliged to deliver at a demonstrably incorrect price.
ARTICLE 11 – CONFORMITY AND WARRANTY
The products comply with the agreement and the applicable legal requirements and guidelines.

ARTICLE 12 – delivery AND EXECUTION
delivery takes place at the address specified by the consumer.
Delivery times are indicative. Delay does not give a right to compensation or cancellation.
The risk of damage or loss passes upon delivery at the specified address.
ARTICLE 13 – PAYMENT
Payment must be made immediately via one of the offered online payment methods.
ARTICLE 14 – COMPLAINTS PROCEDURE
Complaints must be reported in writing within two months after discovery.
ARTICLE 15 – DISPUTES
Dutch law exclusively applies to all agreements.
The Vienna Sales Convention (CISG) is excluded.
ARTICLE 16 – ADDITIONAL PROVISIONS FOR BUSINESS CUSTOMERS
Business customers have no statutory right of withdrawal.

- Restocking fees up to 25% may be charged
- shipping costs will not be refunded
